Important Notice
When ordering Fly And Ride’s services you, as “Consignment Owner”, are agreeing, on your behalf and on behalf of anyone else with an interest in the Shipment, that the Terms and Conditions shall apply from the time that Fly And Ride accepts the Shipment booking unless otherwise agreed in writing by an authorised official of Fly And Ride.
“Shipment” means the vehicle that will be transported by road to it’s agreed booking destination. Every Shipment is transported on a limited liability basis as provided herein. If the “Consignment Owner” requires greater protection than is provided in these Terms and Conditions then additional insurance may be arranged at an additional cost or the “Consignment Owner’ arranges their own independent cover.
By making payment for the booking you are accepting these terms and conditions.
1. Definitions
Consignment Owner – The person who is the legal owner of the vehicle Shipper – Fly And Ride
Shipment – The vehicle and or its contents being transported
Transit – the transportation between Collection Point and Pick Up Point Vehicle – The vehicle included in the Shipment – Car, Motorcycle,van, Lorry, Truck, caravan, engine, motor parts
Transit Vehicle – The vehicle carrying out the transportation
Fly And Ride Packing – The specialist packing which Fly And Ride uses to transport the Vehicle on & in the Transit Vehicle.
Fly And Ride is a trading name of Robert Jones Europe LTD.
2. Acceptable Shipments
The Consignment Owner agrees that its Shipment is acceptable for transportation. It is deemed unacceptable if:
It is used to transport hazardous material, dangerous goods, prohibited or restricted articles by ADR (European Road Transport Regulation on dangerous goods), any applicable government department or other relevant organisation; It contains counterfeit goods, animals, bullion, currency, banderols/tax stickers, bearer form negotiable instruments, precious metals and stones; real or imitation firearms, parts thereof, weapons, explosives and ammunition; human remains, pornography or illegal narcotics/drugs),
It contains any other item which Fly And Ride decides cannot be carried safely or legally.
The consignment owner must supply a manifest of any items that are being shipped with or within their vehicle.
3. Customs
You agree that the ‘Shipment’ does not contain any substance material or item that would require to be declared to customs or require import or export duties.
4. Term
The term of the contract is deemed as being from when Fly And Ride receive the vehicle transportation booking to when it is signed out of a ‘collection point’.
5. The Fee
The fee is for the transportation of the vehicle between Collection and Pick Up points. A deposit paid for the booking is non-refundable. The full booking fee becomes payable 12 weeks before the Transit date and must be within the 7 day terms of the invoice. The booking is not secured until the deposit and booking fee is paid in full. All booking fees must be paid in advance of the shipping. All fees must be paid in advance of the vehicles collection at the end of the shipping period and Fly And Ride reserves the right to retain the vehicle until all charges are paid in full.
6. Additional Fees
Additional storage fees will only be charged in the event the bike is not collected from its outbound destination or inbound destination within a ‘reasonable time’, with the ‘reasonable time’ being a maximum of 24 hours. These storage fees will be charged at cost. In the event of any fees levied by any government or government department that cannot be foreseen or are not current legislation at the time of the booking, then Fly And Ride (Robert Jones Europe LTD) reserve the right to make these charges as an additional cost.
7. Termination & Cancellation
The Consignment Owner may terminate the contract and cancel the shipping up to 12 weeks before the due departure date. If termination is within 12 weeks of the departure date then the full fee is payable to Fly And Ride. If the termination is outside the 12 weeks of the departure date then the booking can cancelled but the no-returnable deposit is payable to Fly And Ride.
If the vehicle has been collected by Fly And Ride under instruction with an agreed destination and the consignment owner changes the agreed destination the full fee will be withheld by Fly And Ride. No part refunds will be given if the consignment owner changes the agreed destination of the vehicle.
8. Delivery to UK Collection Point
It is the consignment owner’s responsibility to deliver the vehicle to the Collection Point. The collection point details will be agreed with the consignment owner at the point of booking.
9. Collection from UK Pick Up Point
It is the consignment owner’s responsibility to pick up the vehicle up from the agreed collection point both outbound and inbound. The pick up of the vehicle must take place within 24 hours of the specified collection time at the outbound or inbound collection point. If the pick up is beyond 24 hours from the inbound or outbound collection point then Fly And Ride reserves the right to make reasonable storage charges as detailed in section 6. Any variation to the 24 hour maximum storage term can be agreed in writing between the parties.
10. Shipment Charges
Shipment charges are for the transportation of the vehicle between the UK Collection Point and the UK Pick Up point. These charges are a fixed charge confirmed at the time of the booking.
11. Transit & Storage
Whilst the vehicle is in transit or in storage then the vehicle is the sole responsibility of Fly And Ride.
12. Fly and Ride’s Liability
Fly And Ride’s liability is strictly limited to direct loss and damage to the vehicle only and is limited to a maximum of
£35,000 any one consignment/shipment. Fly And Ride are insured for this agreed liability with our insurers for your protection.
If the Consignment Owner regards this limit to be insufficient you must make a special declaration of value and request additional agreed responsibility from the Shipper or the Consignment owner must make their own insurance arrangements.
Failing to make any declaration above the limit of £35,000 the Consignment Owner assumes all risks of loss or damages.
